CARe Park Fine - Parking fines at shopping centres, not legal - ANCP complaint

A large number of carparks at shopping centres around Australia are operated by a company called CARe Park, a parking ticketing agency. Another one is Australian National Car Parks Pty Ltd (ANCP). Upon entry to such a carpark, the driver will be required to purchase a ticket to display on the dashboard whilst parked.

Should the driver fail to purchase a parking ticket, they will be issued with a 'fine'. These fines can be up to $60.

If the fine is not paid within the specified period, the unscrupulous company will use unethical methods to obtain the owner's address of the vehicle registration to send a letter of demand, and intention to sue if payment is not made.

I am from NSW and last October I was In Melbourne at beach and I parked in this car park (care park for Vic ppl) that you had to pay for. When I went up to the machine it only accepted coins only which I only had notes, so there were plenty of shops nearby so I proceeded to them to get some change.

I walked past car on way back to machine and noticed it had a fine on it, so then I didnt worry about buying a ticket as I thought what is the point.

A week later I wrote them a letter regarding situation and I never heard about it again untill about 6 weeks ago. They requested I pay the fine. I then sent them an email about the whole thing stating what I had in my letter and that it has been 10 months since the incident I thought it was dropped.

They then sent me another letter and this time I decided to call them and I did twice only for them to promise to call me back but they didnt. I have now got a letter from some lawyers requesting I pay fine amount plus legal costs or it will go to magistrates court.

Now am I thinking it is unreasonable for them to drop this as it has been nearly 12 months since incident, I do kinda think it is a scare tactic to get me to pay as I dont mind wasting there time if it goes to court and I can win.

Tell me your thoughts.

Don't pay it, it's basically a scam. CarePark runs "free" carparks where it is a fine print condition that you have to display a ticket and when you don't show the ticket you get a 'fine'. They are banking on people paying the fine without questioning the legality of it. The ACCC and others have investigated them and stated that their methods of obtaining people's rego details etc to send letters is not legit. They will eventually send threatening letters from lawyers etc. Just ignore them (like I did) as they will not take it to court as it would cost them more than they stand to make- they are just hoping people get scared into paying.

Google them and you'll see heaps of articles about their dodgy tactics

Thanks Stealth, I was wondering the same thing.
Just sent them an email saying i will not pay as the legal basis it was set upon was questionable.

Never pay any 'fine' issued from these dodgy companies. Always deny that you were ever in one of their carparks. The burden of proof is on them and, is their issue with the car, the owner or the driver? You, as a victim, are not required (legally or otherwise)to furnish any information to them regarding who was driving at the time. As such they have no 'case.' Furthermore, if you have been corresponding with them, them ask for photgraphic evidence that your car was parked in one of their car parks (council officers take photos of cars to avoid any disputes). Also, the supermarket or whoever that owns the carpark should be contacted with a threat by you to stop shopping there. I did this with Safeway in Preston (Vic), saying that I spend between $250 and $300 a week and that they would now effectively lose my business. I received an apology, together with a "sorry but its out of our hands," which is rubbish since supermarkets are required to provide parking for customers.

If, in the unlikely event that your case ever gets close to going to court, then get in first and register you case with Consumer Affairs. You will find that ANCP and CARe will quickly pull out, as they don't want any unnecessary publicity. Why would they, when they know full well that they are operating a shonky business.

I received a fine ticket on Sunday 21/08/2011 at the Carlingford Village at 12:05 pm.I feel it is unfair of this fine because I am not from the local area and did not notice any clear warning sign from the entry of the car park about the ticket display.I have not been to this area for a long long time.I do not know there had been changed within this car park.The ticket machine is not obvious in the car park too.For many years the car park has been free for customer already.I fax them many time concerning this matter.Evenually they get back to me and said in the letter (sent out on 31 August and received on 5 September) that I still have to pay $66.I also heard many people complain about this fine too.Do you have any advice to me please?

I was fined by these theiving scum bags, parked, paid for the ticket , 12 hour parking, I wanted to park for 24 hours, no option to do so, returned to the car park to purchase another ticket, but had been booked. $9.00 for 12 hours parking, $66.00 for 1 hour over.this company can go and #@$%^ themselves, I will never use there car parks again

i was surprised to find a parking fine in the the other day and was shocked again when a day later another fine came one from before i owned the car i wrote them a email to let them know but all i got back was a letter telling me the fine is now $165 $88 ticket $77 legal fees so im not going to pay any fines from them
